Gibson Guitar Inc. claims that Activision Inc infringed on one of its patents. Gibson states the game violates its 1999 patent for technology that can simulate a musical performance. Activision has filed a lawsuit asking the U.S. District Court to declare the patent invalid.

Activision released huge quarter three profits nearly doubling its results from a year prior. Activision reported revenues of $272.2 million or 86 cents per share up nearly 90 percent from last year. Analysts were expecting only 80 cents per share. Activision's results were led by strong sales of popular titles "Call of Duty" and "Guitar Hero."

Vivendi Games, who owns games such as World of Warcraft and Crash Bandicoot, reported Sunday that it plans to buy a controlling stake in Activision Inc. and combine the two companies. Under the agreement, shares of Vivendi Games will be converted into 295.3 million new shares of Activision common stock valued at $27.50 each. The transaction is expected to be completed in the first half of 2008.
